Fourth Defendant Sentenced For Role in Atlanta-Based Mexican Sex Trafficking Ring

Severiano Martinez-Rojas, 53, of Mexico, was sentenced on Friday by United States District Judge Edward R. Korman to over 24 years in prison for his role in the sex trafficking of three victims. The amount to be paid in restitution will be announced at a later date.

The defendant is the fourth member of an Atlanta-based Mexican sex trafficking ring convicted for their roles in compelling young women from Mexico and Central America to engage in commercial sex.  Co-defendants Arturo Rojas-Coyotl and Odilon Martinez-Rojas previously pleaded guilty to sex trafficking and were sentenced to 16 years and 21 years and 10 months in prison, respectively. Both defendants were also ordered to pay $180,000 in restitution to the victims.  A third co-defendant, Daniel Garcia-Tepal, pleaded guilty to alien harboring and received a sentence of time served.

“Human trafficking is disgraceful and unacceptable. Today’s sentence demonstrates the Department of Justice’s unwavering commitment to combatting these crimes,” said Assistant Attorney General Eric Dreiband. “This sex trafficking enterprise was extensive and resulted in the abuse of young women and girls. The Civil Rights Division of the Justice Department is thankful for the hard work of the U.S. Attorney’s Office of the Northern District of Georgia, the FBI, and the Homeland Security Investigations team who helped deliver justice on behalf of the victims and survivors.”

“Sex trafficking is a form of modern-day slavery that exploits and traumatizes some of the most vulnerable members of our society,” said U.S. Attorney Byung J. “BJay” Pak.  “We stand united today with our colleagues at the Department of Justice, Eastern District of New York, and federal law enforcement partners, in applauding the courage of the three victims in this case who remained determined to see this prosecution to its conclusion. The lengthy prison sentence that this final defendant has received in this case is primarily the result of the valiant efforts of these human trafficking survivors to hold their traffickers accountable.”

“This case represents why sex trafficking is such a high priority matter for the FBI, our law enforcement partners, and the non-government agencies who provide assistance to those with nowhere else to turn,” said Chris Hacker, Special Agent in Charge of FBI Atlanta. “As one of the worst examples of human trafficking, this case should resonate with those who might consider this reprehensible criminal conduct acceptable. We urge anyone with information about human trafficking activities to contact authorities and help put an end to modern day slavery.”

According to documents filed in court, between 2006 and 2008, defendant Severiano Martinez-Rojas and co-defendants Arturo Rojas-Coyotl and Odilon Martinez-Rojas, lured the three victims into fraudulent romantic relationships using false promises of love, marriage, and legitimate work. They then arranged for others to smuggle the victims across the border into the United States. Once illegally in the United States, the defendants used violence, threats, and intimidation to coerce the victims to perform countless commercial sex acts in the Atlanta area and Alabama, where defendant Severiano Martinez-Rojas also operated a brothel.

Defendant Severiano Martinez-Rojas was indicted in May 2013 but had remained a fugitive until his arrest in Mexico in November 2015 as part of a coordinated U.S.-Mexico bilateral enforcement action. The action also resulted in the arrests of seven other defendants in a related Eastern District of New York case. Martinez-Rojas was also charged, convicted, and sentenced in that case.

Since 2009, the Departments of Justice and Homeland Security have collaborated with Mexican law enforcement counterparts in a Bilateral Human Trafficking Enforcement Initiative. The Initiative seeks to more effectively dismantle human trafficking networks operating across the U.S.-Mexico border, bring human traffickers to justice, restore the rights and dignity of human trafficking victims, and reunite victims with their children.  These efforts resulted in successful prosecutions in both Mexico and the United States, including U.S. federal prosecutions of more than 170 defendants in multiple cases in Georgia, New York, Florida, and Texas since 2009, as well as numerous Mexican federal and state prosecutions of associated sex traffickers.

The case was investigated by the FBI’s Atlanta Division and U.S. Immigration and Customs Enforcement’s Homeland Security Investigations (HSI) Atlanta.  Assistance with the arrest and extradition of defendant Severiano Martinez-Rojas was provided by HSI New York’s Trafficking in Persons Unit, HSI Mexico City Attaché Office, the U.S. Attorney’s Office for the Eastern District of New York, the Department of Justice’s Office of International Affairs, the State Department, and Interpol.  The government of Mexico, including Mexico’s Procuraduría General de la República and Policía Federal, also played a prominent role in advancing the bilateral anti-trafficking enforcement efforts in this case.

Assistant Attorney General Eric Dreiband of the Justice Department’s Civil Rights Division, United States Attorney Byung J. “BJay” Pak of the Northern District of Georgia, FBI Special Agent in Charge Chris Hacker, and Homeland Security Investigations Special Agent in Charge Nick S. Annan, announced the sentence.

The case was prosecuted by Assistant U.S. Attorney Richard S. Moultrie, Jr., Chief of the Violent Crime & National Security Section for the Northern District of Georgia, and Deputy Director of Litigation Benjamin J. Hawk of the Civil Rights Division’s Human Trafficking Prosecution Unit.

      By Jason Hopkins - Newly elected Mexican President Andres Manuel Lopez Obrador intends to curb immigration into the United States by economically developing his country’s northern states. Loprez Obrador — who entered office in the beginning of December with a leftist agenda — on Monday decreed lower rates for income and value-added taxes in over 40 municipalities that border the U.S. The minimum wage within these municipals will also be risen to 177 pesos — equivalent to $9 — beginning in 2019. Lopez Obrador also plans new infrastructure projects and more social welfare programs to benefit Mexican citizens. “This is a very important project to boost investment and job creation,” Lopez Obrador said during a Saturday event in the northern state of Nuevo Leon, according to Reuters. The ambitious agenda is meant to bolster the economic standing of towns and cities dotted along Mexico’s northern border, the forefront of America’s illegal immigration crisis. Lopez Obrador, facing extreme pressure from his northern neighbor, has pledged to reduce migration into the U.S., and hopes to do so by enhancing his citizens’ quality of life. On the other side of the border, the fight over illegal immigration has reached an apex. The federal government has remained in a shutdown because U.S. President Donald Trump and congressional Democrats cannot reach a budget agreement. The Republican president has vowed to veto any bill that does not include funding for a wall on the country’s border with Mexico, and said he is willing to ride a government shutdown for as long as it takes. The immigration battle has drawn ardent public support from both sides. A GoFundMe page, for example, has raised well over $18 million from hundreds of thousands of American donors in just a few days time. “I started this GoFundMe because I felt that politicians and the government wasn’t taking the action that they needed to take,” said Brian Kolfage, a triple-amputee veteran who launched the GoFundMe page, said to The Daily Caller. “Nancy [Pelosi] and Chuck [Schumer], they are doing it for their own political agenda. They don’t want the wall.” The fight over a border wall will continue into the new year.     • Arizona Man Sentenced for Providing Material Support to ISIS

Mitchell - Ahmed Mohammed El Gammal, 46, a resident of Arizona, was sentenced today to 12 years in prison for providing and conspiring to provide material support to the Islamic State of Iraq and al-Sham (ISIS), a designated foreign terrorist organization, aiding and abetting the receipt of military-type training from ISIS, and conspiring to receive such training. A jury convicted El Gammal of these charges on Jan. 30, 2017, following a three-week trial. According to documents publicly filed in this case and evidence presented at trial: Beginning in at least April 2014, El Gammal was an outspoken online supporter of ISIS and ISIS’s Caliphate, or Islamic government, in Syria. Among other things, El Gammal announced on social media that he was “with” “[t]he State of Iraq and the Levant,” referring to ISIS; celebrated ISIS’s achievements in battle and announcement of the establishment of a Caliphate; proclaimed that he “support jihad everywhere”; and declared that “eheadings have a magical effect.” El Gammal additionally announced that “f Daesh [i.e., ISIS] gets to Egypt, I will go join them, so I can torture the Egyptians, and whip them.” As of August 2014, a 24-year-old New York City resident named Samy El-Goarany began to express his support for ISIS on social media as well. On August 14, 2014, El-Goarany learned that El Gammal had made comments supportive of ISIS. Minutes later, El-Goarany contacted El Gammal and they communicated via an encrypted communications platform. Less than an hour after this online conversation, El Gammal sent El-Goarany a documentary on life in the Islamic State that outlined the type of training ISIS provides. Over the next several months, El Gammal and El-Goarany continued corresponding over the Internet, although El Gammal and El-Goarany ultimately deleted many of these exchanges. In the midst of these communications, in October 2014, El Gammal traveled to New York City, where El-Goarany was enrolled in college, and met with El-Goarany. During this October 2014 trip, El Gammal provided El-Goarany with the phone number for El Gammal’s contact in Turkey, Ateia Aboualala, who would be responsible for helping El-Goarany travel from Turkey across the border to ISIS in Syria. While in New York City, El Gammal also contacted Aboualala in Turkey regarding El-Goarany’s plans to travel. El Gammal later provided El-Goarany with social media contact information for Aboualala. Thereafter, in a coded conversation, El Gammal assured Aboualala that he had vetted El-Goarany and El-Goarany could be trusted. In late January 2015, El-Goarany left New York City for Istanbul, Turkey. Upon arriving in Turkey, El-Goarany immediately reached out to Aboualala. While El-Goarany was in Turkey, El Gammal continued to communicate with El-Goarany over the Internet, providing advice on traveling toward Syria and on meeting with Aboualala. After arriving in Syria, El-Goarany received religious training and advanced military-type training from ISIS throughout 2015. On May 7, 2015, in the midst of his training with ISIS, El-Goarany reported to El Gammal that “everything [was] going according to plan.” A few months later, on July 16, 2015, El-Goarany wrote to El Gammal: “Life has changed a lot for me at this new job but I love it and I don’t regret taking up the offer,” and “May God reward you with goodness,” to which El Gammal responded, “Great.” In May 2015, El-Goarany’s father traveled to Turkey and met with Aboualala, in an attempt to locate his son. Upon learning of this, El Gammal instructed Aboualala, “Don’t ever ever mention me. Not even my name[,]” and urged Aboualala not to meet with El-Goarany’s father. On May 5, 2015, Aboualala reported back to El Gammal, assuring El Gammal that, when Aboualala met up with El-Goarany’s father, “I covered up for you.” In coded messages in mid-2015, El Gammal reached out to El-Goarany to inquire about the possibility of El Gammal’s traveling to ISIS in Syria. On July 13, 2015, El-Goarany, again in a coded message, responded that he needed to ask his “supervisors at work first,” but commented that “it’s risky because the parking lot these days is going under a lot of renovation, especially in the north side,” alluding to military operations occurring in northern Syria at the time. On November 23, 2015, El-Goarany’s brother received a message from a member of ISIS with an attached letter from El-Goarany. The letter read: “if you’re reading this then know that I’ve been killed in battle and am now with our Lord, inshaAllah. Remember what I told you . . . we will win this war one day, this war between Iman (Belief) and Kufr (Disbelief) between Good and Evil. . . .” Content created by Conservative Daily News is available for re-publication without charge under the Creative Commons license.     • Michael Cohen Sentenced To 36 Months In Prison

      By Chuck Ross - Michael Cohen, the former personal attorney for Donald Trump, was sentenced to three years in prison by a judge in New York on Wednesday. The sentence, handed down by U.S. District Court Judge William Pauley, is lower than prosecutors’ recommendation that the longtime Trump fixer receive slightly less than between 51 and 63 months in prison. Pauley cited a “smorgasbord” of Cohen crimes before announcing the jail term. Cohen, 52, pleaded guilty on Aug. 21 to tax evasion, bank fraud and making illegal campaign contributions over his payments to Stormy Daniels, the porn star who claims she had an affair with Trump in 2006. Cohen paid Daniels $130,000, he claims at the direction and in coordination with Trump. Legal analysts have debated for days whether Trump is in legal jeopardy, with some observers saying that he could be impeached or even indicted after leaving office. Cohen created shell companies both to avoid paying taxes on his taxi business as well as to make the payment to Daniels. Trump defended the payment on Tuesday, telling Reuters that he did not view it as a campaign contribution. “Michael Cohen is a lawyer. I assume he would know what he’s doing,” he said in an Oval Office interview. “Number one, it wasn’t a campaign contribution. If it were, it’s only civil, and even if it’s only civil, there was no violation based on what we did. OK?” Speaking to the court before his sentence was issued, Cohen largely avoided addressing tax evasion and bank fraud, focusing instead on Trump’s “dirty deeds.” Cohen asserted that his “blind loyalty” to Trump led him to commit many of his crimes. “Today is the day that I am getting my freedom back,” Cohen said, according to reporters in the courtroom. “I have been living in a personal and mental incarceration ever since the day that I accepted the offer to work for a real estate mogul whose business acumen that I deeply admired.” Prosecutors with both the New York office and the special counsel spoke ahead of sentencing. Cohen pleaded guilty in the special counsel’s probe on Nov. 30, admitting that he lied to Congress last year about the extent of his efforts to build a Trump Tower Moscow. Cohen’s attorneys on Nov. 30 asked for a sentence of time served, citing Cohen’s cooperation with prosecutors in New York, the special counsel’s office and the New York Attorney General’s office. New York prosecutors sought a much tougher sentence, recommending that Cohen serve around three-and-a-half years in prison. They claimed that Cohen has engaged in a “pattern of deception” for years and provided much less assistance to their office than he claimed in his court filing. Special Counsel Robert Mueller did not seek additional prison time for Cohen, asserting that the former Trump fixer could serve any sentence in that case concurrently with the New York sentence. Cohen appears to have cooperated more with Mueller’s team than with prosecutors in New York. The Mueller’s team noted that Cohen made false statements about his work on Trump Tower Moscow in his first proffer session on Aug. 7, he corrected the record in an interview on Sept. 12. Cohen eventually provided the special counsel “with useful information concerning certain discrete Russia-related matters core to its investigation that he obtained by virtue of his regular contact with Company executives during the campaign.” It remains unclear what information Cohen provided on any links between the Russian government and Trump campaign. Cohen has not been accused in either case of working with Russians to interfere in the 2016 election.     • Former Congressional Staffer Sentenced to Prison for Extensive Fraud and Election Crimes Scheme

Mitchell - A former congressional staffer was sentenced today to 18 months in prison and ordered to pay $800,000 in restitution, to be followed by three years of supervised release, for participating in a multi-year scheme to defraud charitable donors of hundreds of thousands of dollars and secretly to funnel the proceeds to pay for personal expenses and to illegally finance campaigns for federal office. Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division, U.S. Attorney Ryan K. Patrick of the Southern District of Texas, Assistant Director in Charge Nancy McNamara of FBI’s Washington Field Office and Special Agent in Charge D. Richard Goss of the IRS Criminal Investigation (IRS-CI) Houston Field Office made the announcement. Thomas Dodd, 40, of Houston, Texas, was sentenced in the U.S. District Court for the Southern District of Texas by Chief U.S. District Judge Lee H. Rosenthal.  Dodd was also ordered to forfeit $153,044.28 in illicit gains.  Dodd pleaded guilty on March 20, 2017, to one count of conspiracy to commit mail and wire fraud and one count of conspiracy to make conduit contributions and false statements.  As part of his plea, Dodd admitted that he participated in a scheme led by former U.S. Representative Stephen E. Stockman, 62, who was convicted by a federal jury in Houston on April 12 of 23 counts of mail fraud, wire fraud, conspiracy to make conduit contributions and false statements to the Federal Election Commission (FEC), making false statements to the Federal Election Commission, making excessive coordinated campaign contributions, money laundering, and filing a false tax return.  Another of Stockman’s former congressional staffers, Jason T. Posey, 48, of Tupelo, Mississippi, pleaded guilty on Oct. 11, 2017, to one count of mail fraud, one count of wire fraud, and one count of money laundering. According to the evidence presented at Stockman’s trial, from May 2010 to February 2014, Stockman and his co-defendants solicited $1,250,571.65 in donations from charitable organizations and the individuals who ran those organizations based on false pretenses, then used a series of sham nonprofit organizations and dozens of bank accounts to launder the money before it was used for a variety of personal and campaign expenses. Specifically, the evidence established that in 2010, Stockman and Dodd solicited an elderly donor in Baltimore, Maryland for $285,000 to be used for legitimate charitable and educational purposes.  Stockman and Dodd used a sham charity named the Ross Center to funnel the money to be used for a variety of personal expenses.  The evidence further established that, in 2011 and 2012, Stockman and Dodd received an additional $165,000 in charitable donations from the Baltimore donor, much of which Stockman used illegally to finance his 2012 congressional campaign. The trial evidence also showed that shortly after Stockman took office as a member of the U.S. House of Representatives in 2013, he and Dodd used the name of another sham nonprofit entity, Life Without Limits, to solicit and receive a $350,000 charitable donation, to be used to create an educational center called the Freedom House.  Stockman, Dodd, and Posey instead used this donation for a variety of personal and campaign expenses, including illegal conduit campaign contributions, a covert surveillance project targeting a perceived political opponent, an in-patient alcoholism treatment for a female associate, and payments for hundreds of thousands of robocalls and mailings promoting Stockman’s candidacy for U.S. Senate in early 2014. In addition, the evidence established that, in connection with Stockman’s Senate campaign, Stockman and Posey used another sham nonprofit entity to secure a $450,571.65 donation in order to fund a purportedly legitimate independent expenditure promoting Stockman’s candidacy.  The evidence showed that the purportedly independent expenditure was in fact secretly controlled by Stockman, who directed his campaign and Posey to file false affidavits with the FEC covering up Stockman’s involvement. Finally, the evidence at trial demonstrated that Stockman failed to pay taxes on any of the $1,250,571.65 in fraudulently acquired donations.  In addition, during the early stages of the investigation, Stockman directed Posey to flee to Cairo, Egypt, for two and a half years so that Posey could not be questioned by law enforcement. The FBI and IRS-CI investigated the case.  Deputy Chief Robert J. Heberle and Trial Attorney Ryan J. Ellersick of the Criminal Division’s Public Integrity Section and Assistant U.S. Attorney Melissa Annis of the Southern District of Texas are prosecuting the case.
