Whistleblower Advocates, Attorneys Condemn FBI Raid On Clinton Foundation Whistleblower

Whistleblower advocates across the political spectrum condemned an FBI raid on the home of a recognized whistleblower who reported potential wrongdoing surrounding about the Clinton Foundation, the Uranium One deal and former Secretary of State Hillary Clinton.

The Daily Caller News Foundation, in a bombshell report, detailed how 16 FBI agents raided the home of Dennis Cain, a former employee of an FBI contractor, on Nov. 19. They rummaged through his home for six hours even though he told them that Department of Justice Inspector General Michael Horowitz awarded him whistleblower status, according to Cain’s lawyer, Michael Socarras.

Horowitz instructed a top aide to personally hand-carry the documents to the House and Senate intelligence committees over the summer after he received them from Cain, Socarras said.

Everyone TheDCNF interviewed said the raid should never have occurred. They said it appeared Cain followed the rules in accordance to the Intelligence Community Whistleblower Protection Act, which protects federal whistleblowers from retaliation.

“I really do question the need for this raid at all,” said Nick Schwellenbach, the investigations director for the Project on Government Oversight, a nonpartisan watchdog group that frequently works with whistleblowers. “On its face it doesn’t seem like it was necessary.”

“This isn’t how we should be treating whistleblowers who are coming forward with information about high level wrongdoing,” he told TheDCNF. “It sends a very strong message that you will be treated as a criminal even though what you’re trying to do is expose crime or a potential crime.”

Craig Holman, a lobbyist for Public Citizen, the liberal advocacy group founded by Ralph Nader, told TheDCNF: “Well it certainly sounds like an absolute violation of the spirit of what the whistleblower law is supposed to be all about.”

The documents Cain possessed, which he gave to the special agent leading the search, show that federal officials failed to investigate potential criminal activity pertaining to Clinton, the Clinton Foundation, and the Russian company that purchased Uranium One, according to a document TheDCNF reviewed.

The court order and all the documents justifying the raid are sealed and are not available for public viewing. Federal magistrate Stephanie A. Gallagher of the U.S. District Court of Maryland in Baltimore issued the court order on Nov. 15.

TheDCNF asked the court on Friday to unseal the documents. Gallagher has not yet responded.

A conservative attorney on ethics law, Cleta Mitchell, questioned whether the FBI was truthful when it sought the court order.

“If they did not fully advise the court of his whistleblower status, then I would find that to be extremely troublesome,” she said. “The main question is whether or not they properly informed the court that this individual is a whistleblower and that he had gone through the procedures to receive whistleblower status.”

“Until Mr. Cain’s attorney is able to see what the FBI or the U.S. Attorney presented to the court in order to obtain this search warrant, then we have no way of knowing and he has no way of knowing whether they fully and properly advised the court that he had whistleblower status, and whether they informed the judge that he had gone through all of the proper procedures,” Mitchell continued.

Schwellenbach said the judge should release the original documents filed by the FBI and the U.S. Attorney.

“I would love to see what’s in their subpoena request to the judge,” he told TheDCNF. “What facts do they present to the judge? I think that is a document that should see the light of the day.”

Senate Judiciary Committee Chairman Chuck Grassley asked FBI Director Christopher Wray in a Nov. 30 letter whether the bureau was “aware at the time of the raid that Mr. Cain had made what appeared to be lawful disclosures to the Inspector General?”

Texas defense attorney Stuart Baggish told TheDCNF that the search of Cain’s home could be a violation of the Fourth Amendment, which protects against unreasonable search and seizures. Baggish is challenging a recent raid on his client’s business after local law enforcement allegedly omitted key facts before a judge when justifying the search.

“If the search warrant for Mr. Cain’s property was based on an affidavit that purposely or recklessly omitted his whistleblower status, like my client’s case against the Smith County Sheriff [in Texas], the search could be ruled unreasonable and hence a Fourth Amendment violation,” he said.

“Material information may occasionally inadvertently be left out of a search warrant affidavit, but it is rare and dangerous when it is done purposely or recklessly,” Baggish continued.

Schwellenbach, the POGO investigator, told TheDCNF: “I think the FBI needs to be thoughtful how it uses these powers. Judges need to be skeptical of FBI claims.”

“They shouldn’t be raiding people’s homes unless there’s a real compelling reason to do so and alternative means have been exhaustive,” he continued.

Baggish warned that such raids also undermine the judiciary and violate civil rights.

“When law enforcement officers intentionally mislead a court to obtain a search warrant, they are entering a realm of malfeasance that harms not just the individual or entity whose property is raided, destroyed and confiscated, they also harm the judiciary itself by depriving it of its efficacy as the guardian of Americans’ civil rights,” he said.

The DHS referred to these potential terrorists as “special interest aliens” or SIAs and said they’re constantly looking for new and creative ways to enter the U.S. undetected. “Offering solutions to close these routes and shut off entry ways into America for SIAs must be a priority moving forward, since some of these migrants have been affiliated with foreign terror groups and organized crime,” the report reads. It also cited a U.S. State Department report claiming terrorists are seeking to infiltrate Latin America to take advantage of their “porous borders, limited law enforcement capabilities, and established smuggling routes.” “These vulnerabilities offered opportunities to local and international terrorist groups and posed challenges to governments in the region,” the State Department report continued. The Center for Immigration Studies also released a report back in late November showing at least 15 confirmed cases where members of terrorist groups were encountered at the U.S.-Mexico border, or right after they had illegally crossed.     • Trump Foundation To Dissolve As Lawsuit From New York Attorney General Continues

      By Evie Fordham - The Donald J. Trump Foundation signed a stipulation agreeing to dissolve Tuesday, but a lawsuit by the New York state Attorney General’s office against the charity continues. President Trump had offered to dissolve the foundation in 2016, but the New York Attorney General at the time, Eric Schneiderman, blocked the dissolution so his office could investigate, reported The Washington Post. The Trump Foundation will divide up its remaining assets among other charities under judicial supervision, with approval resting with new state Attorney General Barbara Underwood, she announced in a press release Tuesday. “Our petition detailed a shocking pattern of illegality involving the Trump Foundation – including unlawful coordination with the Trump presidential campaign, repeated and willful self-dealing, and much more,” Underwood said in a statement Tuesday. “This amounted to the Trump Foundation functioning as little more than a checkbook to serve Mr. Trump’s business and political interests.” Trump has denied that the foundation did anything wrong, reported WaPo. The lawsuit from Underwood’s office is still going on in Manhattan Supreme Court, reported CNN. It seeks $2.8 million in restitution plus penalties and “a bar on President Trump and his three eldest children from serving on the boards of other New York charities,” according to the press release. Underwood announced the suit in June and alleged that Trump “used the Trump Foundation’s charitable assets to pay off his legal obligations, to promote Trump hotels and other businesses, and to purchase personal items” in a press release that month. Underwood discussed her decision to sue the Trump Foundation with CNN’s Christiane Amanpour June 14. “This is politics at its very worst,” a Trump Foundation spokesperson told The Daily Caller News Foundation in June. “The Foundation has donated over $19 million to worthy charitable causes – more than it even received … The Foundation currently has $1.7 million remaining which the [New York Attorney General] has been holding hostage for political gain.” The foundation has never had more than a few million dollars in the bank, peaking at $3.2 million in 2009, according to WaPo. WaPo has alleged that Trump used the foundation’s funds to pay legal settlements for his private business, to make an illegal political donation and even to purchase art for a club he owns.     • US Lawmakers Officially Condemn Russia’s Natural Gas Pipeline Into Germany

      By Jason Hopkins - The House of Representatives voted on Tuesday to condemn Russia’s Nord Stream 2 pipeline, a natural gas pipeline project that the U.S. believes will undermine Europe’s energy security. “It attempts to drive a wedge between NATO allies,” said Texas Republican congressman Michael Conaway, the sponsor of the resolution. The Texas lawmaker went on to say Russia’s claims about the project — such as that Europe is in need of more pipeline infrastructure and that the project would reduce gas prices — were downright false. “Nord Stream is a danger to peace as we know it. Our NATO colleagues should see clearly what it is,” Conaway continued. House lawmakers on Tuesday voted in favor of H.Res. 1035, a non-binding resolution that “expresses opposition to the completion of Nord Stream II, the gas pipeline that would transport natural gas from Russia through the Baltic Sea to Germany, urges the President to support European energy security through a policy of diversification to lessen reliance on Russia,” and supports “the imposition of sanctions with respect to Nord Stream II,” according to a congressional summary of the resolution. Nord Stream 2 is a pipeline project which, if completed, will transport natural gas across the Baltic Sea from Russia to Germany — with the ability to move around 55 billion cubic meters of natural gas a year. The proposal has been warmly welcomed by the Germany, which expects its natural gas demand to increase. Russia also wants to see Nord Stream 2 reach fruition, where it could potentially double its natural gas exports to Germany under the Baltic Sea. The project, however, is sharply opposed by U.S. and E.U. leaders. Russia already wields commanding influence over Europe’s energy  market, controlling almost 40 percent of the continent’s supply of gas. A total of 11 European nations currently rely on Russia for 75 percent or more for their annual gas needs. Russia’s near monopoly of Europe’s gas market would only be cemented further if Nord Stream 2 is completed, regional leaders worry. “If built, Nord Stream 2 could alter the landscape of the EU’s gas market while not giving access to a new source of supply or a new supplier,” European Commission President Jean-Claude Juncker wrote in a June letter to several E.U. members states. “No market operator should be able to leverage a position of dominance to the detriment of competitors and consumers.” As an alternative to Russian energy, President Donald Trump has highly touted American LNG to his European counterparts. The president, who has made U.S. energy dominance a major part of his platform, has held strategic talks with Juncker and president of Poland about buying more American natural gas. The hardline position the U.S. taken has not helped American-German relations.       By Richard Pollock - The Department of Justice is requesting that the justification of an FBI raid on a reportedly recognized whistleblower’s home remain secret, according to a letter from U.S. Attorney Robert Robert Hur. The letter was sent to the U.S. District Court for the District of Maryland on Dec. 7 in response to The Daily Caller News Foundation’s Nov. 30 request to unseal court documents that would show the FBI’s rationale for the raid. The documents could potentially reveal whether the bureau and the magistrate who signed the court order allowing the raid, Stephanie A. Gallagher, knew that the subject was, according to his lawyer, a recognized whistleblower. Sixteen FBI agents raided Dennis Cain’s Union Bridge, Maryland, home on Nov. 19 for six hours, even though Cain told them that he was a recognized whistleblower and handed classified documents over to the agents. The documents Cain possessed reportedly showed that federal officials failed to investigate potential criminal activity regarding former Secretary of State Hillary Clinton, the Clinton Foundation, and the Russian company that purchased Uranium One. Cain gave the documents to Justice Department Inspector General Michael Horowitz, who had a senior official from his office hand-deliver them to the House and Senate Intelligence Committees, according to Cain’s layer, Michael Socarras. Cain, a former employee of an FBI contractor, has not been arrested in connection with the raid. Whistleblower advocates and defense attorneys have condemned the raid, and Senate Judiciary Committee Chairman Chuck Grassley demanded that FBI Director Christopher Wray justify the raid and divulge whether the bureau knew about Cain’s reported disclosure. The Iowa Republican gave Wray until Dec. 12 to respond. Hur did not address Cain’s reported status as a protected whistleblower in his letter to the court and instead appeared to employ boilerplate objections to keep the documents out of the public. He also did not invoke national security concerns or claim that Cain possessed classified information.
