John Calvin puts forward a very simple reason why love is the greatest gift: “Because faith and hope are our own: love is diffused among others.” In other words, faith and hope benefit the possessor, but love always benefits another. In John 13:34–35 Jesus says, “A new command I give you: Love one another. As I have loved you, so you must love one another. By this everyone will know that you are my disciples, if you love one another.” Love always requires an “other” as an object; love cannot remain within itself, and that is part of what makes love the greatest gift.

    • House Oversight Set To Drag Wilbur Ross In Front Of Congress Over Citizenship Question

      By Evie Fordham - The House Oversight Committee will question Commerce Secretary Wilbur Ross in March about a citizenship question he supported adding back to the 2020 census, the committee announced Tuesday. The announcement from the committee, which is headed by Democratic Maryland Rep. Elijah Cummings, comes less than a week after a federal judge ordered the removal of the question Jan. 15. U.S. District Judge Jesse Furman said that Ross’s department violated federal law by including a citizenship question. Ross is scheduled to testify voluntarily on March 14, nearly a year after members of the committee began requesting documents from him, according to a committee press release. Some critics of returning to asking a citizenship question on the census questionnaire say that it could “lead to a significant undercount of immigrants fearful of revealing their citizenship status,” according to The Wall Street Journal. However, the fight to include a citizenship question on the 2020 census questionnaire will likely be fast-tracked to the U.S. Supreme Court. The issue is urgent because the Census Bureau must finish up the questionnaire by June. Furman also accused Ross of hiding his motives for adding a citizenship question in the Jan. 15 decision. Congressional Democrats are also expected to investigate former Interior Secretary Ryan Zinke and acting Attorney General Matthew Whitaker in for questioning as well, reported The WSJ. Democratic Sens. Kamala Harris of California and Tom Carper of Delaware introduced a bill during the 115th Congress on July 31 to counter the Trump administration’s citizenship question. Their bill, the Census Equality Act, would have required the decennial census and American Community Survey to collect data on citizens’ sexual orientation and gender identity. It did not pass the Senate, and the legislation actually worried some LGBT advocates who did not see an advantage to compiling that kind of data on people who fall under the LGBT umbrella.     • Trump Administration Will Ask The Supreme Court To Protect The Census Citizenship Question

      By Kevin Daley - The Trump administration will ask the Supreme Court to decide whether the government can append a citizenship question to the 2020 census questionnaire, the Department of Justice said Tuesday. U.S. District Judge Jesse Furman forbade the government from incorporating the citizenship question on Jan. 15 in a sweeping decision that ran almost 300 pages. At the administration’s bidding, the Court agreed to review a separate question arising from the citizenship case in December. After Furman issued his decision, the plaintiffs asked the justices to dismiss that case. The Department of Justice responded to that request in court filings on Tuesday, revealing they planned to appeal Furman’s decision in full directly to the high court. “The government intends to file forthwith a petition…to review the district court’s January 15, 2019 opinion and order vacating and enjoining the reinstatement of the citizenship question to the 2020 decennial census,” Solicitor General Noel Francisco wrote. Francisco emphasized the pressing time constraints at hand: the government must finalize the census questionnaire by June, which is not enough time for the ordinary appellate process to play out. “It is exceedingly unlikely that there is sufficient time for review in both the court of appeals and in this Court by that deadline,” Francisco wrote. Therefore, he continued, granting the administration’s request to hear the case now “is likely the only way to protect this Court’s opportunity for review.” Commerce Secretary Wilbur Ross issued orders providing for the addition of a citizenship question to the census survey in March 2018. The Department of Commerce oversees the Census Bureau. Tuesday’s filing from the government is the latest in a succession of cases in which the Trump administration has short-circuited normal judicial process and asked the Supreme Court to review a district court decision before a federal appeals court does. Those requests, called petitions for certiorari before judgment, are rarely granted. A sprawling coalition of civil rights groups, city governments, and blue states filed lawsuits challenging the citizenship question’s inclusion in April 2019. Those plaintiffs warn the citizenship question will reduce minority participation in the census. As such, the plaintiffs say they stand to lose federal funds and representation in Congress. The Constitution mandates a census every 10 years to apportion seats in the House of Representatives among the states. Population is also used as a basis for rewarding federal aid. A citizenship question was included in the census until 1960.     • Federal Judge Orders Removal Of Citizenship Question From 2020 Census

      By Kevin Daley - A federal judge in New York barred the Trump administration from including a citizenship question on the 2020 census questionnaire. The decision appears to have significant implications for a related matter the Supreme Court is poised to decide in the spring. “The attempts by the Trump administration to mandate a question about citizenship were not rooted in a desire to strengthen the census process and would only undermine our immigrant communities,” New York Attorney General Letitia James said in a statement. “Inciting fear in our residents is not only immoral, but also ill-conceived.” The Constitution mandates a census every ten years to apportion seats in the House of Representatives among the states. Population is also used as a basis for rewarding federal aid. A coalition of Democratic cities, states, and interest groups challenged the addition of a citizenship question to the census questionnaire in April 2018, warning it would discourage minority participation. An incomplete survey of minority populations, the plaintiffs feared, would result in diminished federal funds and congressional representation for urban areas. The plaintiffs charged that the addition of the citizenship question violated the Constitution and the Administrative Procedure Act (APA), a federal law establishing protocols for the issuance of regulations. In his Tuesday decision, U.S. District Judge Jesse Furman accepted the plaintiffs’ APA claims while rejecting their constitutional arguments. “[Ross] failed to consider several important aspects of the problem; alternately ignored, cherry-picked, or badly misconstrued the evidence in the record before him; acted irrationally both in light of that evidence and his own stated decisional criteria; and failed to justify significant departures from past policies and practices — a veritable smorgasbord of classic, clear-cut APA violations,” Furman wrote. Elsewhere in the decision, Furman said Ross was not truthful about his motives for adding a citizenship question. Though the secretary initially said publicly that the question was added at the request of the Department of Justice, subsequent evidence showed Ross discussed the matter with White House aides far earlier than initially understood. “Finally, and perhaps most egregiously, the evidence is clear that Secretary Ross’s rationale was pretextual — that is, that the real reason for his decision was something other than the sole reason he put forward in his memorandum,” Furman wrote. Former President Barack Obama elevated Furman to the federal bench in 2012. The plaintiffs sought a deposition from Commerce Secretary Wilbur Ross at a previous phase of the litigation. The Department of Commerce oversees the Census Bureau, and Ross himself authorized the addition of the citizenship question. Though Furman authorized the Ross deposition, the Supreme Court intervened to stop it in October 2018. Shortly thereafter in November 2018, the high court agreed to decide what evidence Furman could rely upon when making his decision. When plaintiffs challenge agency action in court, the agency itself generally turns over the body of documents and evidence it relied upon to make its decision. Those writings are called the administrative record. In most cases of this nature, the court will make its decision based only on the administrative record. However, Furman allowed the plaintiffs to gather evidence beyond the administrative record to challenge the citizenship question. The Supreme Court agreed to decide whether that decision was correct.
