He said that is “clear that Barr intended to mislead the public.” He has been a frequent critic of Trump and suggested in March that he will not rule out running for the Libertarian Party nomination for president in 2020. Amash also co-sponsored a resolution seeking to block the president’s emergency declaration to help build a wall across the border with Mexico. The House Judiciary Committee voted on May 8 to vote to hold Barr in contempt of Congress for not providing the committee Mueller’s full, unredacted report. House Republicans balked at the move.   2. By Jason Hopkins - Stephen Miller’s attempt to shift the soon-to-be ICE director nominee to another agency left acting Homeland Security Secretary Kevin McAleenan threatening to quit. Miller — a White House senior adviser who’s taken an outsized role with immigration issues — urged President Donald Trump on Wednesday to make Mark Morgan the next commissioner of Customs and Border Protection (CBP), according to officials who spoke with The Washington Post. Miller reportedly wanted Morgan to lead CBP, despite him being tapped by the president to be the next Immigration and Customs Enforcement (ICE) director, because Miller wanted the current acting ICE director to remain in place. However, this request did not sit well with Department of Homeland Security (DHS) Secretary Kevin McAleenan, the man who leads all of DHS’ various agencies. McAleenan on Thursday told senior administration officials, including White House chief of staff Mick Mulvaney, that he was the leader of the department — not Miller. The acting DHS chief went on to argue that personnel decisions should left up to him, or at the very least he should be involved in the decision-making process. One White House aide who spoke to The Washington Post likened the altercation to an “immigration knife fight.” McAleenan ended up winning the White House brawl: Morgan will become next acting ICE director next week, and Matthew Albence — the current acting ICE director — will go back to his position as ICE deputy director. The incident marked the latest White House immigration clash involving Miller. It was recently discovered that, prior to then-DHS chief Kirstjen Nielsen’s removal in April, she blocked a secret White House plan backed by Miller that called for apprehending thousands of parents and children in a sweeping operation to crack down on illegal immigration. Both Nielsen and then-ICE acting director Ron Vitiello had objected to “hastily put together” plan, arguing the administration wasn’t prepared. The Trump administration embarked on a major immigration staff shakeup in April — removing Nielsen from DHS, pulling Vitiello’s nomination to officially lead ICE, and accepting acting Deputy Secretary for Homeland Security Claire Grady’s resignation. By Chuck Ross - Former FBI general counsel James Baker said Friday that he viewed the Steele dossier “skeptically” and was “concerned” about the veracity of the document when the bureau received it before the 2016 election. But despite those concerns, Baker was one of the FBI officials who reviewed the Carter Page surveillance warrant application, which relied heavily on information from the dossier. The dossier, which was written by former British spy Christopher Steele, has come under intense scrutiny in the wake of the special counsel’s report, which undercut Steele’s core claim of a “well-developed conspiracy of co-ordination” between the Kremlin and Trumpworld. Steele, who worked during the 2016 campaign for the Clinton campaign and DNC, alleged that Page was one of the Trump campaign’s liaisons to the Kremlin. The first of four Foreign Intelligence Surveillance Act (FISA) warrants was granted against Page on Oct. 21, 2016. “It was more information that we viewed, that I viewed, skeptically from the outset, and I was concerned about it and had a jaundiced eye, or looked at it with a jaundiced eye right from the outset,” Baker told MSNBC’s Chuck Todd. “Steele was and had been a source that we thought was reliable. He’s reporting all this information. It looks alarming. We took it seriously, but we tried to vet it.” Steele first provided information from his Trump investigation on July 5, 2016. But his reports reportedly did not make their way to the FBI team leading the Trump probe until mid September 2016. The FBI was aware that Steele was working for Democrats, and that he had told a Justice Department official that he was “desperate” to see Trump lose the 2016 election. Baker, who resigned from office in May 2018, is considered an expert on FISA. He was the top Justice Department official in the office that handles FISAs before joining the FBI. He has testified to Congress that he rarely reviewed FISA applications in his FBI job, but made an exception for the Carter Page application. Baker said Friday that he believes that FISAs against Page would have been granted even without the dossier. Mitchell - McALLEN, Texas – U.S. Border Patrol Stations and the Centralized Processing Center to include the Donna Temporary Facility are holding an average of 8,000 illegal aliens in recent days, a result of waves of migrants fleeing El Salvador, Guatemala and Honduras. Despite the addition of a soft-sided temporary facility constructed in Donna, Texas, the sheer number of illegal aliens crossing through the Rio Grande Valley has reached record levels, straining the sector’s capacity to process individuals. In order to create more capacity, agents and other personnel tasked to patrol the border have been re-assigned to construct four temporary structures at both the McAllen and Rio Grande City Border Patrol stations in order to provide additional shelter for individuals awaiting their turn to be processed. These additional structures, which are equipped with generators, lighting and HVAC systems expand the sector’s processing capacity. “The longer illegal aliens remain in custody, the harder it can become to sustain our operations but housing the migrants in these tents is the default solution,” said Chief Patrol Agent Rodolfo Karisch. “This is the reality of what happens when we simply cannot handle the influx of migrants arriving. We are doing all we can to ensure a safe environment for all involved but it is crystal clear that we have a real emergency on the border; this is not sustainable.” At the Centralized Processing Center, individuals receive new clothing and shoes in addition to food and medical care. Costs to maintain and accommodate the needs of those being in custody have reached the tens of thousands of dollars per day. Members of the DHS Surge Capacity Force, which is comprised of civilian employees along with the Coast Guard, Federal Protective Service, Office of Field Operations and Department of Defense (DOD) personnel from throughout the nation are assisting the sector in transporting migrants; providing administrative support, meal distribution and monitoring the welfare of individuals in CBP custody, however; DOD personnel are not conducting law enforcement actions. The care and support provided to the record number of individuals crossing the Southwest Border have created challenges for the agents who now have to split their core mission of protecting national security with the care of the record number of individuals under their custody. With the increase in the number of crossings come health concerns, as the sector is seeing a proportional increase in trips to local hospitals. Currently, RGV sector averages 20 hospital visits per day which may impact local hospital wait times.   5. By Kevin Daley - The Trump administration has asked the Supreme Court to strike down a New York City ordinance strictly regulating the transportation of firearms. The ordinance at issue prohibits licensed gun owners from transporting weapons to any location, save one of seven authorized gun ranges. License holders are not permitted to take their firearms beyond city limits. “To confine a weapon to the home is thus to preclude the owner from using it for many of the purposes that the right to keep and bear arms is meant to serve,” Solicitor General Noel Francisco told the justices in court papers. The plaintiffs are Second Amendment activists who wish to transport their firearms outside the city to participate and shooting competition and defend their vacation homes. A federal trial judge and the 2nd U.S. Circuit Court of Appeals upheld the regulations, prompting an appeal to the Supreme Court. The 2nd Circuit said the transport ban protects “the public safety of both license-holding and non-license-holding citizens.” The case is the first gun rights dispute the justices have heard in almost a decade. In a brief supporting the plaintiffs, Francisco compared New York’s ordinance with federal statutes governing the movement and possession of firearms. Though federal law bars minors from possessing guns and bans firearms in school zones, those prohibitions do not apply to people transporting unloaded weapons in locked containers in the course of completing some lawful activity like hunting. “The city’s ban subjects adults to more severe restrictions than Congress considered necessary for children, and it subjects the entire city to more severe restrictions than Congress considered necessary for school zones,” Francisco wrote. While the rules at issue only apply in New York City, the case is potentially significant because the justices could announce new standards for judging Second Amendment disputes. The Supreme Court has never said whether lower courts should use strict or permissive legal standards for assessing gun control laws. The administration cautioned that the justices do not need to broach that issue to strike down the New York ordinance. “The Court need not decide what additional indicia of constitutional meaning judges should consult when interpreting the Second Amendment,” Francisco wrote. “In this case…text, history, and tradition definitively establish the unconstitutionality of the city’s near-total ban on the transportation of handguns outside the home,” he added. After the justices granted review of the case on Jan. 22, the city announced it would promulgate more permissive gun transportation rules. Lawyers for the city told the Court on April 12 that the new rules will “moot” the case, since the ordinance that set off the dispute will be repealed. As such, the city argues the appropriate course for the Court will be to dismiss the case after the new rules are implemented. The case is No 18-280 New York State Rifle and Pistol Association v. This would make Sanders the first 2020 presidential candidate to suggest such a policy, according to CNN. Todd Lopez - A handful of common themes have emerged from among the installations named as top performers in the effort to reduce suicide numbers among service members, families and civilians, the director of the Defense Human Resources Activity said. “The theme has been consistent among these award winners: community, family, connection, connection, connection. And more connections,” William H. Booth said. “That’s the way we can drive the numbers in the right direction. Across our department right now, the numbers are not going in the right direction. So from this group of award winners, we need to take those best practices and try to drive it across the entire Department of Defense.” The Army, Navy, Air Force, Marine Corps and National Guard each identified one installation they believed was doing the best work toward suicide prevention during Suicide Prevention Month last year. Representatives from each of those installations traveled to Washington to be recognized for suicide prevention efforts. Winning Installations Fort Carson Fort Carson, Colorado, whose Suicide Prevention Month program adopted a “Value of Life” theme, which was promoted throughout September. Message boards were placed across the installation that encouraged individuals to post and share inspirational and motivational thoughts. Fort Carson’s kickoff event was a community picnic that was attended by more than 600 soldiers, family members, veterans and local residents. During the month, Fort Carson also expanded awareness about suicide prevention strategies and resources through unit-level awareness and resource briefings that reached more than 400 soldiers. 2. Marine Corps Air Station Iwakuni Marine Corps Air Station Iwakuni, Japan, kicked off Suicide Prevention Month with an American Forces Network radio live stream that provided factual suicide prevention and intervention information to more than 3,000 listeners. They also published articles on behavioral health and suicide prevention in the September issue of their installation magazine and hosted events that provided information about suicide prevention, including strategies for assisting distressed individuals and accessing installation resources. Nearly 600 active-duty service members, dependents and civilian personnel visited these events. 3. Joint Base Pearl Harbor-Hickam At Joint Base Pearl Harbor-Hickam, Hawaii, the Suicide Prevention Month program focused on community engagement and increasing awareness about the power of bystanders through publications, a targeted social media campaign, outreach to high-risk populations, awareness and prevention training, and engagement with installation leadership. They kicked off the month with a joint-service suicide prevention proclamation signing and a resource fair that had nearly 1,000 participants. The event also featured a pledge drive for participants to commit to take steps to prevent suicide and interactive photo opportunities using the #BeThere and #PreserveOurOhana slogan. 4. Misawa Air Base The Suicide Prevention Month program at Misawa Air Base, Japan, was focused on educating the community about suicide prevention and strengthening interpersonal connections. The base developed conversation cards that encouraged participants to discuss suicide prevention topics, including stress management and tips for building connections. More than 17,000 Misawa Connect cards were placed in various locations, including dining facilities, the bowling alley, the base chapel and the golf course. 5. Camp Atterbury The Indiana National Guard’s Camp Atterbury hosted the “Got Your Six, Be There: Your Action Could Save a Life” 5K run/walk/bike event to bring attention to service members who have died by suicide and to support individuals currently struggling with suicidal thoughts and behaviors. The run was held in conjunction with Camp Atterbury’s community day to emphasize the importance of community involvement in preventing suicide and to highlight suicide prevention resources. More than 130 people, representing nearly every branch of the military, participated in the race. In addition, 44 deployed service members participated in a shadow run in Kuwait. Suicide prevention efforts at all five installations, as well as by similar teams at other installations across the department have “worked hard to create opportunities for their community members, both military and civilian,” said Karen A. Orvis, director of the Defense Suicide Prevention Office. “We know that’s so important for suicide prevention. They built on that ‘be there’ theme through a variety of activities. From suicide prevention trainings, publications, media efforts, and community activities to foster engagement and connections and a variety of other means to get out that critical information about suicide prevention and intervention strategies and resources.” You may not know the names or faces of every individual you have helped. … But you have been there for them.” Elizabeth P. Barr approved the creation of the State and Local Law Enforcement Coordination Section (SLEC-S) within the Office of Legislative Affairs. As of June 3, 2019, the SLEC-S will be responsible for ensuring that Department leadership is properly informed of state and local law enforcement’s top priorities, while working to ensure that the Department has an impactful presence within the state and local law enforcement community. SLEC-S will serve as the primary liaison with state and local law enforcement, and all supporting entities. “State, local, and federal law enforcement officers are all a part of the same team,” Attorney General William P. Barr said. “The events of Police Week serve as a powerful reminder that the vast majority of this team serves on the front lines — at the state and local levels. In order to further strengthen the Department of Justice’s relationships with our state and local law enforcement partners, I am pleased to announce that the Department has established a State and Local Law Enforcement Coordination Section. By Michael Bastasch - The northeastern U.S.’s largest supplier of natural gas stopped processing new customer applications in New York City and Long Island after the Cuomo administration blocked a major pipeline project. The moratorium is the second to hit New Yorkers in 2019 as a result of Democratic Gov. Andrew Cuomo’s opposition to natural gas pipelines needed to meet growing demand in the state and New England. “We are not processing new applications for any new customers,” National Grid New York President John Bruckner said Thursday. “We’ll continue to receive requests for service, but we’re not processing them.” New York officials rejected a water permit application for the Northeast Supply Enhancement pipeline project Thursday, claiming it would “result in water quality violations” as currently planned. For many observers, the rejection wasn’t much of a surprise. Cuomo wants the state to adopt his version of the Green New Deal to cut greenhouse gas emissions and end fossil fuel use. The 24-mile pipeline would run from New Jersey to New York Bay through Raritan Bay. National Grid, a regional power and gas provider, said it would be forced to impose a moratorium if the pipeline isn’t approved. The Trump administration has used Cuomo’s blocking of natural gas pipelines as a reason to expedite project approvals and re-examine state authority over water quality permits. Cuomo promised to fight any attempt by the White House to curtail state water permitting authority. “New York is hurting the country because they’re not allowing us to get those pipelines through, and that’s why they’re paying so much for their heating and all of the things that energy and our energy produces,” Trump said after signing pipeline executive orders in April. “So hopefully they can come on board and get in line with what’s happening,” Trump said. Environmentalists cheered the state’s blocking of the Northeast Supply Enhancement pipeline. “The state has made it clear that dangerous gas pipelines have no place in New York. This is a victory for clean water, marine life, communities and people’s health across the state,” Natural Resources Defense Council senior attorney Kim Ong told Politico. “Along with our allies, we will continue to ensure this reckless project is shelved forever,” Ong said. Cuomo’s administration rejected several major pipeline projects in recent years. New York’s opposition to pipelines is a major contributor to natural gas shortages in the Northeast, particularly during winter. But natural gas shortages aren’t just relegated to winters anymore. In March, utility Consolidated Edison put a moratorium on new natural gas hookups across parts of Westchester County. Local officials worry the moratorium will hurt the economy and raise energy prices. However, Bruckner said he’s “confident they’ll be able to provide information to mitigate” the state’s concerns. New York allowed Williams Co., the company building the pipeline, to resubmit its application. Until then, National Grid warned larger customers, like businesses and industrial facilities, they may not receive natural gas on extremely cold days. In an interview with Fox News, Barr was asked about the hearing, where Democrats voted to hold Barr in contempt of Congress for not giving the committee special counsel Robert Mueller’s full, unredacted report, Barr responded by saying “It’s part of the usual game, you know, political circus that’s being played out. It doesn’t surprise me,” he said. “I don’t feel threatened.” Barr’s comments come after the committee, led by New York Democratic Rep. Jerry Nadler, originally gave Barr a deadline of May 6 by 9 a.m. to turn in the full report with no redactions, which many Republicans believe would be dangerous due to the possibly sensitive material that could be leaked. Barr did not budge. Before the vote, The White House said the president would use executive privilege to prevent Democratic lawmakers from getting the materials they’re requesting. “Even in redacted form, the Special Counsel’s report offers disturbing evidence and analysis that President Trump engaged in obstruction of justice at the highest levels. Congress must see the full report and underlying evidence to determine how to best move forward with oversight, legislation, and other constitutional responsibilities,” Nadler said in a statement on May 6. Democrats and cable news pundits have said the Mueller report is a cover-up. By Peter Hasson - The Democratically controlled House of Representatives voted Friday 236-173 in favor of the Equality Act, which would require schools to include male athletes who identify as transgender girls on female sports teams. Eight Republicans crossed party lines to vote for the bill, which had unanimous Democratic support. The bill amends the Civil Rights Act of 1964 to make “sexual orientation and gender identity” protected characteristics under federal anti-discrimination law. Among other things, that would force public schools to expand female athletic teams to include biological males who identify as transgender girls. Republican Florida Rep. Greg Steube introduced a last-minute amendment to the bill that would have preserved Title IX’s protections of female athletic teams, but Democrats rejected it. Every House Democrat but one co-sponsored the legislation. The only Democrat who wasn’t a co-sponsor, Illinois Rep. Dan Lipinski, announced his support for the bill following pressure from left-wing activists. “People need to wake up. This radical bill is going to totally eliminate women’s and girls sports,” Republican Arizona Rep. Debbie Lesko warned in an op-ed Thursday. Republican Missouri Rep. Vicky Hartzler and a half-dozen other House Republicans held a press conference Thursday in opposition to what Hartzler dubbed the “Inequality Act.” “Congress enacted Title IX to provide equal opportunities for women in education and sports. All this is erased under H.R. 5,” Hartzler said at the press conference. Three former elite female athletes, Doriane Coleman, Martina Navratilova and Sanya Richards-Ross, warned that the Equality Act would wreak havoc on women’s sports in an April 29 Washington Post op-ed. “The legislation would make it unlawful to differentiate among girls and women in sports on the basis of sex for any purpose. For example, a sports team couldn’t treat a transgender woman differently from a woman who is not transgender on the grounds that the former is male-bodied,” the former athletes wrote. “Yet the reality is that putting male- and female-bodied athletes together is co-ed or open sport. And in open sport, females lose,” the three women warned. House Judiciary Chairman Jerry Nadler, a Democrat from New York, insisted the bill wouldn’t put female athletes at a disadvantage. “Many states have sexual orientation and gender identity nondiscrimination laws, and all of them still have women’s sports. Arguments about transgender athletes participating in sports in accordance with their gender identity having competitive advantages have not been borne out,” Nadler said at an April 2 hearing on the bill. In Connecticut, one of the states to which Nadler was referring, two male runners have dominated girls’ high school track. By Michael Bastasch - A major U.K.-based newspaper will swap out the terms “climate change” and “global warming” for “stronger language to describe the situation we’re in,” according to the editor-in-chief. The Guardian newspaper announced Friday it will swap the term “climate change” for “climate emergency, crisis or breakdown,” and “global warming” will be substituted for “global heating.” “We want to ensure that we are being scientifically precise, while also communicating clearly with readers on this very important issue,” said Guardian editor-in-chief Katharine Viner. “The phrase ‘climate change,’ for example, sounds rather passive and gentle when what scientists are talking about is a catastrophe for humanity.” “Increasingly, climate scientists and organizations from the UN to the Met Office are changing their terminology, and using stronger language to describe the situation we’re in,” Viner said in a statement. However, terms like “climate crisis” are not used in serious scientific studies or literature. Instead, phrases meant to sound the alarm on global warming mostly come from activists and politicians pushing an agenda. By Chuck Ross - Attorney General William Barr said in an interview that aired Friday that he is investigating what role the Steele dossier played in the Russia probe, and that the salacious document had “a number of clear mistakes.” “It’s a very unusual situation to have opposition research like that, especially one that on its face had a number of clear mistakes and a somewhat jejune analysis,” Barr told Fox News’ Bill Hemmer. “And to use that to conduct counterintelligence against an American political campaign is a strange — would be strange development.” In the interview, Barr spoke at length about an inquiry he launched at the Justice Department into the origins of the Russia investigation. He told The Wall Street Journal in an interview that the investigation is also focusing on what information U.S. intelligence agencies gathered on Trump campaign associates before the FBI formally opened its investigation in July 2016. The FBI relied heavily on the Steele dossier, which was funded by the DNC and Clinton campaign, to obtain surveillance warrants against Carter Page, a Trump campaign adviser. But Republicans have accused the FBI of misleading the surveillance court by relying on the dossier given that its allegations were unverified. Christopher Steele, a former British spy, claimed in the dossier that the Trump campaign was involved in a “well-developed conspiracy of co-operation” with the Russian government to influence the 2016 election. He alleged that Page and other Trump associates, like Paul Manafort and Michael Cohen, were at the center of the scheme. But the special counsel’s report all but debunked the dossier’s central thesis, while dismissing one specific allegation about Cohen. The report said that prosecutors were unable to establish a conspiracy between the Trump team and Russia. It also said that Cohen did not visit Prague in August 2016, which is where the dossier claimed the former Trump lawyer went to pay off Russian hackers. Steele and his client, Fusion GPS, shopped the dossier around to numerous journalists. Steele also provided memos from his dossier to the FBI and State Department. Barr told Hemmer that the answers he has received so far about the origins of the investigations “aren’t sufficient.” He is reportedly working with the directors of the CIA, FBI and Office of National Intelligence on the inquiry. The Justice Department’s inspector general is also investigating the dossier’s role in the Russia investigation, as well as the FBI’s surveillance efforts against the Trump campaign. By Chris White - Billionaire Tom Steyer is taking a break from attacking President Donald Trump and is now blaming congressional Democrats for sitting on their hands while a “lawless president” laughs at them. “For over two years this president has broken the law and nothing happens,” one person can be heard saying in Steyer’s new ad, which aired Thursday night. Other people featured in the ad chime in: “You told us to wait for the Mueller investigation, and when he showed obstruction of justice, nothing happened.” The people in the ad went on to list a number of offenses activists believe Trump engaged in, such as supposedly ignoring lawmaker’s requests for his tax returns. “Now you tell us to wait for the next election? Really?” they all say in unison. They add: “This is why we volunteered. Raised money. Went door to door. Voted in the last election. Our founding fathers expected you — Congress — to hold a lawless president accountable.” Steyer appears at the end of the ad to remind listeners that the “system is broken. We have to fix it.” Steyer’s campaign has dumped millions of dollars over the course of the past year on what many Democrats worry is an ill-fated attempt to impeach the president. House Speaker Nancy Pelosi, for instance, told reporters in January that she wanted to wait for special counsel Robert Mueller to complete his investigation. The California billionaire is frustrated that Democrats are still pulling their punches after Mueller published his report. He plowed $6 million into the Need To Impeach campaign in January, the bulk of which was slated for national cable and broadcast advertising in early presidential primary states like Iowa, Nevada and South Carolina. Approximately $2.5 million went to television campaigns while another $3.5 million was earmarked for a digital effort, according to media reports. Steyer’s donations came as Democrats regained the House after nearly a decade in the wilderness. Some of the incoming freshmen Democrats took the opportunity to jump headfirst into the impeachment push. Democratic Michigan Rep. Rashida Tlaib, for instance, told a crowd in January that “we’re gonna go in there and impeach the mother****er.” Steyer, for his part, flirted with the possibility of running for president in 2020, but ultimately passed on the opportunity. He worried that his past investments in fossil fuels could hurt him among a Democratic Party turning away from oil. By Luke Rosiak - Two FBI officials who worked in counterintelligence and described themselves as friends with either Peter Strzok or Lisa Page said they did not pick up that their colleagues were having an extramarital affair, according to transcripts of testimony obtained by TheDCNF. These friends both worked on the FBI’s investigation into Hillary Clinton’s email server. A former undercover federal agent said such seeming obliviousness reflects poorly on the work on that Clinton case and also that Strzok may have weaponized his FBI training in the art of deception for nefarious purposes. Two FBI officials who worked closely with Peter Strzok and Lisa Page had no idea about the pair’s extramarital affair, they testified to a congressional committee, even though they work for an investigative agency and considered themselves friends. The two who did not pick up on any signs of an affair played key roles in the investigation into Hillary Clinton’s private server use, which did not result in any criminal charges after FBI head James Comey drafted an exoneration speech before the investigation had concluded. FBI personnel are trained to look for activity that could lead to an agent being blackmailed, which could include an extramarital affair. A former undercover federal agent, Wayne Black, told The Daily Caller News Foundation that the officials’ blindness to the affair says something about the the Clinton probe, in which important leads were allegedly not followed. But it also, he said, suggests that Strzok used his FBI-provided training in the art of deception to become a cunning liar, a talent turned against his wife, his colleagues and investigators examining his role in the Trump-Russia investigation. TheDCNF obtained unreleased transcripts of testimony from the two officials to the House committees on oversight and the judiciary. Both testified in the summer of 2018. Jonathan Moffa, now deputy assistant director at the FBI, worked as a counterintelligence analyst for 20 years. “When the Midyear Exam Investigation began and it was based in the counterespionage section, they put me in charge of the analytic team associated with that investigation,” he testified. The investigation into Clinton’s emails was codenamed Midyear Exam. Moffa, who knew Strzok well enough to go to ballgames with him in addition to interacting heavily at work, said he never picked up the clues that two colleagues were having an affair. Q: I think I have a pretty clear understanding, going way back several hours ago, what your professional relationship with Mr. Strzok was. Did you have a social relationship with him at all? A: Yeah, I think we had a limited social relationship. And by that term, I mean kind of the classic work friend. So occasionally, you know, you’d catch a game or, you know, I think our families had met a couple of times, two or three times. But certainly not, like, a regular social interaction. We worked together very closely, and I think, like anybody you work with closely for years — and I knew Pete for more than 10 years — you get to know them as a person. But what I wouldn’t say is we were, like, close social companions outside of the office, in large part because we spend a lot of time interacting in the office, and so there was no need to interact outside of it. Q: Prior to all the news reporting about the texts and all the drama about that, prior to any of that, were you aware of an extramarital affair going on around you? A: No, I actually wasn’t. He never spoke to me about it, and I had no evidence of that to point to. Congressional investigators grilled Moffa on whether detecting affairs was a part of FBI training, given that someone in Strzok’s position could be blackmailed by a foreign power with the threat of exposing his sexual affair: Q: In your training, knowledge, and expertise as a counterintelligence professional, as a counterintelligence analyst, and as an FBI employee, is a tool used to recruit assets in the espionage world the fact that someone might be having an extramarital affair? A: In a general sense, I think any exploitable fact like that could be used in that way, sure. Q: Is extramarital affair specifically something that the FBI cautions about for potential weakness to a hostile adversary? A: I don’t know if we do or not, to be honest, if in any of our security guidance that’s called out or not. I just don’t recall it. The second employee was Sally Moyer, a unit chief at the FBI’s Office of General Counsel, where Page worked, who said she was “friends” with Page inside and outside of work. “I started as an assistant general counsel, and then eventually I was promoted to unit chief. And the whole time I’ve worked in the counterintelligence law unit,” she said of her 13 years with the Bureau. “So for Midyear Exam, I was an acting unit chief at the time.” Q: And you were close friends with Lisa Page? A: I was friends with her, yeah. […] Q: And when you say “friends,” you socialize outside of work? A: Yes. […] Q: Were you aware she was having an affair with Peter Strzok? A: No. Q: So you learned about it when the public learned about it through the texts and the publication of certain texts? A: I learned about it when the, I believe The Washington Post had an article. […] Q: Is there concern in espionage matters, or is an indication or a vulnerability to commit espionage, is having an extramarital affair something that you’re familiar with in your knowledge of espionage matters? A: That’s one of many factors that can be used to try to recruit a subject. […] Q: Real quickly going back just a second. If we were told by an FBI employee that you affirmatively reported the Lisa Page/Peter Strzok affair to supervisors, how would you assess the validity of that information? A: That’s not true. Moyer was represented at the deposition by lawyer Bill Pittard. He also represented Floridan Democratic Rep. Debbie Wasserman Schultz in her efforts to prevent the Capitol Police from examining evidence tied to her IT aide Imran Awan, who House authorities deemed “an ongoing and serious risk to the House of Representatives.” In July, Judiciary Committee member Rep. Louie Gohmert, a Texas Republican, implied that Strzok he had deployed his skills in deception as a counterintelligence agent against Congress and his own wife. “How many times did you look so innocent into your wife’s eyes and lie to her about Lisa Page?” Gohmert said. “You do it with a straight face and I watched you in the private testimony you gave and I told some of the other guys, ‘he is really good, he’s lying, he know, we know he’s lying and he can probably pass the polygraph.’” The FBI declined to comment for this story. Black, the former undercover agent, said he believes that on some level, Strzok and Page’s colleagues must have suspected the affair, but chose to remain in the dark — which he compared to what he said was a willful ignorance when it came to pursuing the Clinton email probe. “When they say they didn’t know, do they just mean they never walked in on them having sex? Intel is proactive, not reactive,” Black told TheDCNF. “You don’t wait until something slaps you in the face. When you’re in the intel field you’re sensitive to something, you come up with a hypothesis, and you try to disprove or prove it.” “Either they suspected it and got into denial and didn’t talk about it, or they knew about it and suppressed it,” he continued. “Either way they should have reported it, because [affair participants are] subject to blackmail.” As for Strzok, “Someone in his position has extensive undercover and counter-intel training, so if he’s doing something untoward, it’s second nature for him to use that deception training. He’s in survival mode.
