  1. By Matt M. Miller - Immigration and Customs Enforcement denies allegations that it shut down a hotline for detained migrants to contact a free lawyer. The California-based organization Freedom for Immigrants offered a free hotline for detained migrants to request pro bono legal representation while in detention centers, the Los Angeles Times reported Friday. ICE shut down the hotline less than two weeks after it was featured in an episode of “Orange Is The New Black,” according to the organization. ICE denied the allegation in a statement Saturday to the Daily Caller News Foundation explaining that detainees are still able to contact Freedom for Immigrants, though the hotline was removed from an ICE-approved list of free legal service providers for violating regulations. “Detainees are further allowed to make free calls to an ICE-approved list of free legal service providers for the purpose of obtaining initial legal representation. Because these legal calls are unmonitored and unrecorded, certain prohibited activities, to include three-way calling and call forwarding, are strictly prohibited,” the statement said. “Pro bono organizations found to be violating these rules may be removed from the platform. However, removal from this platform in no way limits the ability of an ICE detainee to phone such an organization directly should the detainee wish to do so,” it continued. Cox, southern region communication director for ICE. Freedom for Immigrants responded Thursday with a cease and desist letter to ICE, challenging the removal of the hotline from the platform as being in violation of freedom of speech, the Los Angeles Times reported. “Even a freely given benefit such as the pro bono hotline can’t be taken away simply because the government is now unhappy with how we are sharing with the public what we know from our communications with people inside,” the co-executive director of Freedom for Immigrants, Christina Fialho, said according to the report. The Freedom for Immigrants hotline was prominently featured on an episode of “Orange Is The New Black” that was released on Netflix in July, following the plotline of a character who was being detained in an ICE facility, according to the Los Angeles Times. The Journal’s investigation found 4,152 products, including 2,000 toys and medications, for sale on Amazon that would be banned on regular U.S. store shelves due to their health risks. Amazon removed or altered wording for 57% of the listings after the Journal brought attention to their safety risks. Within two weeks, however, at least 130 items with the same policy violations returned to the site, some listed by the same sellers previously identified by the Journal.   3. By Kevin Daley - The Supreme Court announced Friday that Justice Ruth Bader Ginsburg was successfully treated for pancreatic cancer. Friday’s announcement is the second time in recent months the justice disclosed a serious medical condition after she completed treatment. In both instances, her diagnosis remained closely held for several weeks. The last 10 months have been particularly punishing for the 86-year old progressive icon. The justice fractured three ribs in a November fall at the high court, causing her to miss Justice Brett Kavanaugh’s ceremonial investiture. One month later in December, Ginsburg and had two cancerous nodules removed from her left lung. She missed the Court’s January sitting to recuperate from the procedure, but continued participating in cases. The Supreme Court’s Public Information Office said in a Friday statement that doctors “confirmed a localized malignant tumor” on Ginsburg’s pancreas after a July 31 biopsy. Thereafter, Ginsburg completed a three-week course of outpatient radiation therapy at Memorial Sloan Kettering Cancer Center in New York City, at which time the public was informed of the diagnosis. The Court said the tumor has been “treated definitively and there is no evidence of disease elsewhere in the body.” Ginsburg was treated for pancreatic cancer once before. Doctors surgically removed an early-stage tumor in 2009, when she was 75. The gauntlet of health challenges did not seem to take a toll on the justice. She appeared fully engaged in oral arguments throughout the spring and has kept an active travel schedule, including an international trip to Portugal in July. Even as she underwent radiation therapy in New York, she attended Broadway productions of “Fiddler on the Roof” and “Moulin Rogue” according to theatre-goers who recounted sightings on social media. Yet there are subtle signals that Ginsburg’s famous efficiency is slowing. She wrote just six majority opinions this term, while her colleagues each produced seven or eight decisions for the Court. What’s more, her total page production is down as compared to previous years. Her opinions totaled 131 pages this term, down 33 pages from the 164 she produced one term prior. There is no standardized process for the justices to make medical disclosures to the public. Each member of the Supreme Court makes their own determinations about fitness and transparency. Legislation pending in Congress requires all federal judges, including the justices, to submit to periodic medical exams. The bill calls for all judges to undergo an examination every five years, with more regular assessments as they age. Results of those reviews would be kept confidential, unless a physician identifies a condition that “may impact the ability of the judge or justice to carry out the duties of the judge or justice’s position,” at which point the head judge of the relevant court would be informed of the diagnosis. By Jason Hopkins - The former acting director of Immigration and Customs Enforcement (ICE) argued that new Justice Department data show illegal immigration is not a victimless crime. “I think it that validates illegal immigration is not a victimless crime. Many come to this country and violate the laws against the citizens of this country,” Tom Homan, who lead ICE during the first year-and-a-half of the Trump administration, said Friday on Fox News’ “Outnumbered” program. “Last year, ICE arrested over 142,000 criminal aliens. These are people that violate laws entering this country and commit yet another crime on top of that.” Homan was reacting to newly-released data from the Justice Department that showed a significant increase in arrests of non-citizens over the past two decades. Despite making up only 7% of the entire U.S. population, non-citzens amounted for 64% of all federal arrests in 2018. Federal arrests of non-citizens over the past twenty years increased by 234%, while federal arrest of U.S. citizens only grew by 10%. While a majority of the arrests were due to immigration violations, a high proportion of non-citizens were booked for federal fraud, property and drug arrests. Illegal re-entry into the U.S., drugs, fraud, alien smuggling and misuse of visas were identified as some of the top crimes committed by non-citizens. One panelist on Outnumbered pointed to a Casto Institute analysis in March that found immigrants commit crimes at lower rates than native-born citizens. Another commentator suggested that one way to reduce the number of federal arrests is to “do what Democrats want” and decriminalize illegal immigration. “First of all, no one on this couch is going to educate me on illegal alien crime. The CATO study is a flawed study. It’s not based on crime data, it’s based on surveys,” Homan responded. “Most crimes are done by state and local… Many are violent. What you can’t get — you can’t get crime data on that because it doesn’t exist. Most of them don’t track whether they are illegal here or not.” “It isn’t how many — who commits more crimes.   5. By Shelby Talcott - Around 15 jail workers have been subpoenaed following Jeffrey Epstein’s apparent suicide while in a Manhattan jail August 10, according to a prison official. Multiple inquires have been opened into accused child sex trafficker Epstein’s death. U.S. Attorney General William Barr cited “serious irregularities” at the facility holding Epstein, the New York Times reported. The specific roles of the subpoenaed employees are not known, according to the NYT. Barr noted Wednesday that there have been delays with the investigation “because a number of the witnesses were not cooperative.” Epstein was allegedly not checked on for about three hours the night he died. Two employees accused of sleeping on the job and falsifying records at the jail where Epstein was held have already been placed on administrative leave, and the warden of the jail has been reassigned. The subpoenas are an attempt to get testimony from jail employees and are part of an inquiry from FBI prosecutors and investigators from NY’s Department of Justice’s inspector general, a person with knowledge of the investigation said according to the NYT. Eric Young, the president of the union that represents federal prison workers, hit back at Barr’s comment that workers were not cooperating with ongoing investigations into Epstein’s death. “The Justice Department would like employees to waive away their minimum constitutional right to representation,” Young said Thursday, the NYT reported. “That’s what they consider to be a cooperative employee.” The multimillionaire had powerful friends, some of whom have become wrapped up in sex trafficking allegations. Prince Andrew is one of the people accused of having sex with minors through Epstein, but has denied the allegations. Epstein’s death was ruled a suicide by the New York City medical examiner Aug. 16.   6. By Chuck Ross - CNN added to its stable of retired FBI and CIA officials Friday by hiring Andrew McCabe, who was fired by the bureau due to a lack of candor during an internal probe. McCabe is the 10th ex-FBI or CIA official hired by the network in recent years, with MSNBC having hired five. A vast majority of the 15 CNN/MSNBC analysts have pushed the now-debunked theory that the Trump campaign conspired with Russia. CNN added to its deep roster of former FBI and CIA officials-turned-analysts Friday with the hiring of Andrew McCabe, the former FBI deputy director fired for lack of candor during an investigation last year. McCabe is the tenth ex-FBI, CIA or intelligence community official CNN has hired during the Trump administration, according to a Daily Caller News Foundation analysis. MSNBC has followed closely behind, having hired five former officials, including former CIA Director John Brennan. CNN was widely mocked on Friday after announcing the McCabe hiring, largely because the network has criticized its competitors for hiring former Trump administration officials. But the personnel move is also part of a larger trend that has come under scrutiny from some media observers. Jack Shafer, a media critic who writes for Politico, noted the potential pitfalls of networks like CNN and MSNBC having a stable of ex-spies and G-men as paid, on-air contributors. “But the downside of outsourcing national security coverage to the TV spies is obvious,” Shafer wrote in a Feb. 5, 2018 article at Politico. “They aren’t in the business of breaking news or uncovering secrets. Their first loyalty — and this is no slam — is to the agency from which they hail.” Glenn Greenwald, an editor at The Intercept who covers national security issues, echoed that sentiment during a Fox News interview in March. “And not only did MSNBC and CNN use those people as their sources, they hired them as their news analyst. So if you turn on CNN or MSNBC, it was basically state TV. It was CIA TV,” he told Tucker Carlson March 26. Greenwald and others have noted the lopsided analysis offered up by the former officials, especially on the topic of the Trump-Russia probe. Most have hewed to their networks’ general viewpoint that Trump or his associates conspired with Russia. Others, like McCabe, Brennan, and former national intelligence director James Clapper, have all defended the investigation of the Trump campaign. They’ve maintained their defense even in the wake of the special counsel’s report, which debunked the theory that the Trump campaign conspired with Russia. Here is a rundown of CNN and MSNBC’s most prominent analysts. CNN James Clapper, director of national intelligence under President Obama. As the nation’s top intelligence official, Clapper was intimately involved in the investigation of possible ties between the Trump campaign and Russian government. He set up a now-infamous Jan. 6, 2017 meeting with top intelligence officials and then-President-Elect Donald Trump. During that briefing, then-FBI Director James Comey told Trump about the existence of the Steele dossier. Four days later, CNN reported that the briefing occurred. Hours after that, BuzzFeed News published the Steele dossier in full. Republicans have accused Clapper of leaking information to CNN for its report, though he has denied it. Andrew McCabe, former FBI deputy director. CNN announced on Friday that McCabe would serve as a law enforcement analyst. McCabe was fired from the FBI on March 16, 2018 upon the recommendation of the bureau’s Office of Professional Responsibility. An investigation determined that McCabe lacked candor under oath regarding his authorization of a leak to the media in October 2016 regarding the FBI’s investigation of the Clinton Foundation. McCabe sued the Justice Department and FBI Aug. 8, claiming that he was fired due to pressure from Trump. James Baker, former FBI general counsel. Baker, a CNN legal analyst, left the FBI in May 2018 under a cloud of suspicion. In a congressional interview on Oct. 18, Baker’s lawyer revealed he was under criminal investigation for an unauthorized leak to the media. Baker was also deeply involved in the FBI’s Trump-Russia investigation. He personally reviewed the surveillance warrant applications against Trump aide Carter Page. The applications relied heavily on the unverified Steele dossier. Baker had contact prior to the 2016 election with Mother Jones reporter David Corn, his longtime friend. Corn passed Baker parts of the Steele dossier in hopes of confirming the FBI was investigating claims from the salacious documents. Baker also told Congress he met in September 2016 with Michael Sussmann, a lawyer for the DNC. Baker said that Sussmann provided him with documents alleging there were covert communications between a Russian bank and the Trump Organization. Josh Campbell, former FBI aide to James Comey. The Daily Caller News Foundation reported on Feb. 8, 2018 that the FBI circulated a flyer in honor of Campbell’s gig, saying that he was embarking on a “new endeavor defending the bureau.” Like McCabe and Baker, Campbell often appears on CNN to defend the FBI’s investigation of Trump. Asha Rangappa, former FBI special agent and leading collusion conspiracy theorist. Steven Hall, former CIA Moscow station chief and outspoken critic of Trump. Phil Mudd, former FBI and CIA official. Mudd, who is known for his fiery presentations on CNN, has largely been a critic of President Trump. But he has also pushed back on some of the underlying aspects of the Trump-Russia probe. He predicted June 4 that an inspector general’s investigation into the Steele dossier will “not end up well” for Christopher Steele, the former British spy who wrote the salacious document. Susan Hennessy, former attorney for the National Security Agency. Hennessy has also been a leading proponent of the now-debunked theory that the Trump campaign conspired with Russia. Samantha Vinograd, former adviser to the Obama administration’s National Security Council. On March 2, Vinograd said on CNN that a speech Trump made reminded her of Adolf Hitler. She also said that Trump’s speech included items on “Putin’s to-do list.” James Gagliano, former FBI supervisory special agent. Gagliano typically discusses breaking news stories regarding active shootings, terrorism incidents. He has been an outspoken critic of both James Comey and Andrew McCabe. MSNBC John Brennan, former CIA director. Brennan appeared frequently on the network during the Russia probe, and has been a fierce critic of Trump. In the weeks before the special counsel’s report was released, Brennan inaccurately predicted that members of Trump’s family would be indicted in the investigation. Frank Figliuzzi, former FBI assistant director for counterintelligence. On Aug. 6, Figliuzzi floated a theory on air that Trump’s decision to lower flags in honor of mass shooting victims earlier this month was somehow tied to white supremacy. Figliuzzi noted that Trump’s order to lower the flags would expire on Aug. 8. Using numerology, Figliuzzi argued that the date, 8/8, is significant for white supremacists because it translates into “Heil Hitler.” Chuck Rosenberg, former chief of staff to James Comey and administrator of the Drug Enforcement Administration. Like most of his colleagues, Rosenberg’s analysis has typically perpetuated the theory that Trump & Co. conspired with Russia. Rosenberg also argued in a report published at Lawfare on Dec. 14 that the Steele dossier “holds up well over time, and none of it, to our knowledge, has been disproven.” That assessment has not held up well in the months since Rosenberg published the piece. The special counsel’s probe undercut the dossier’s core claim that the Trump campaign took part in a “well-developed conspiracy of co-operation” with the Russian government. The investigation also undercut the dossier’s most specific claim of collusion: that former Trump lawyer Michael Cohen visited Prague in August 2016 to meet with Russian intelligence officials.   7. By Mary Margaret Olohan - Washington state withdrew Thursday from the federal family funding program Title X rather than comply with new rules imposed by the Trump administration. The Washington Department of Health informed the Department of Health and Human Services (HHS) of their decision to withdraw from Title X rather than comply with the Trump administration rules banning Title X grantees from referring women for abortions. “The State of Washington is gravely disappointed in HHS’s deliberate decision to force us and many other longstanding grantees out of the Title X program,” two state officials said in a letter to HHS, the Hill reports. “These new rules require our providers to deprive their patients of the information and services they need to make and carry out fully informed decisions about their reproductive health.” Washington sued over the new rules and reportedly told HHS earlier this week that the state would not comply with the new rules. However, the state also asked that they be allowed to stay in the Title X program, without using the funding, while their case was in court. HHS denied this request, saying that Washington must comply by Friday or face the termination of their grant. This might impede future federal funding for the state, HHS told Washington state officials, according to the Hill. The Trump administration declared in July that taxpayer-funded clinics must stop referring women for abortions effective immediately. Family planning clinics that refer women for abortions will be stripped of their Title X funding, according to a measure Trump’s administration instigated, CBS News reported. The rules require organizations that perform abortions or make abortion referrals to do so in separate buildings from those that receive Title X federal funds. HHS had set a Monday deadline for Title X grantees to show that they were complying with the new rules, according to the Hill. Planned Parenthood also withdrew from Title X Monday, thereby forgoing about $60 million a year. “We will not be bullied into withholding abortion information from our patients,” acting Planned Parenthood President Alexis McGill Johnson said on a call to reporters, according to Politico. The move comes after Planned Parenthood officials petitioned for a stay against the Trump administration’s Title X rules in an Aug. 14 letter to the U.S. Court of Appeals for the 9th Circuit, NPR reported. The organization said it would pull out of the family planning program unless the court intervened. HHS did not respond to a request for comment from the Daily Caller News Foundation. Mitchell - Earlier today, at the federal courthouse in Brooklyn, Asia Siddiqui and Noelle Velentzas, both citizens of the United States and residents of Queens, pleaded guilty to teaching and distributing information pertaining to the making and use of an explosive, destructive device, and weapon of mass destruction, intending that it be used to commit a federal crime of violence. The guilty pleas were entered before United States District Court Judge Sterling Johnson Jr. When sentenced, the defendants face up to 20 years in prison. “Inspired by radical Islam, Velentzas and Siddiqui researched and taught each other how to construct bombs to be used on American soil against law enforcement and military targets,” said Assistant Attorney General John C. Demers. “They were thwarted by the excellent work of the agents, analysts and prosecutors who are responsible for this investigation and prosecution. For this, we are grateful.” “In an effort to implement their violent, radical ideology, the defendants studied some of the most deadly terrorist attacks in U.S. history, and used them as a blueprint for their own plans to kill American law enforcement and military personnel,” stated United States Attorney Richard P. Donoghue. “Thanks to the tireless work of law enforcement, they were stopped before they could bring their murderous plans to fruition.” “Velentzas and Siddiqui were intent on waging violent jihad here in the United States, researching at length historical terrorist attacks on U.S. soil, educating themselves on how to turn propane tanks into explosive devices, and dreaming up plans to kill Americans on our own turf,” stated FBI Assistant Director-in-Charge William F. Sweeney Jr. “Today’s plea is not only a welcome end to this years-long investigation, but a credit to the FBI’s JTTF in New York and our many law enforcement partners who saw this through to the end.” “This investigation and the subsequent guilty pleas are yet another example of how each day the NYPD and members of the Joint Terrorism Task Force remain vigilant and relentless in their efforts to protect New York City and keep America safe,” stated NYPD Commissioner James P. O’Neill. “I want to commend our law enforcement partners and the U.S. Attorney’s Office for the Eastern District for helping to bring these individuals to justice.” Between approximately 2013 and 2015, Velentzas and Siddiqui planned to build a bomb for use in a terrorist attack in the United States. In furtherance of their plan, the defendants taught each other chemistry and electrical skills related to creating explosives and building detonating devices; conducted research on how to make plastic explosives and how to build a car bomb; and shopped for and acquired materials to be used in an explosive device. They discussed similar devices used in past terrorist incidents, including the Boston Marathon bombing, Oklahoma City bombing and 1993 World Trade Center attack, and they researched potential targets of attack, focusing on law enforcement and military-related targets. Siddiqui’s interest in violent terrorist-related activities was reflected in her written submissions to a radical jihadist magazine edited by Samir Khan, a now-deceased prominent figure and member of the designated foreign terrorist organization, al-Qaeda in the Arabian Peninsula (AQAP). Velentzas similarly espoused violent rhetoric, praising the attacks of Sept. 11, 2001, and stating that being a martyr through a suicide attack guaranteed entrance into heaven. Velentzas specifically singled out government targets stating, “you go for the head” when you commit a terrorist attack. Tom Malinowski told a crowd that illegal immigrants are needed to mow “our beautiful lawns” and work other undesirable jobs that U.S. citizens don’t want to do. “There are a lot of jobs in our community that, like it or not, for better or worse, Americans are not willing to take,” Malinowski said in video obtained by the Washington Examiner. “I mean who do you think is taking care of our seniors?” “Who do you think is mowing our beautiful lawns in Somerset County. We don’t usually ask, but a lot of those workers are undocumented. There are just not a lot of, you know, kids — sorry — from Montgomery High who are going to be doing that full time,” the first-term Democrat said, which prompted laughter from the young audience. Malinowski then told the people in attendance that they would be going into robotics after graduating, suggesting that menial jobs would need to be occupied by immigrants. “You’re a bunch of elitists! You’re not going to mow lawns!” The New Jersey Democrat was speaking at a Tuesday event held at Cafe Brio in Hillsborough, a wealthy suburban area in the state. This isn’t the first time Malinowski — who worked in the Obama administration before entering Congress — has been caught on camera making controversial comments. In the run-up to the 2018 midterm elections, he accused the Republican Party of carrying a “white nationalist” identity. “My party is having a debate right now about the best way to provide health care to Americans,” he said during a September debate with then-GOP Rep. Leonard Lance. “The Republican Party right now — not in New Jersey so much, but in Washington, D.C. — is having a very different kind of debate. It’s having a debate about whether to be a white nationalist party or not.” Malinowski occupies New Jersey’s 7th Congressional District. By Kevin Daley - A high school classmate of Justice Brett Kavanaugh is suing HuffPost for defamation over an article about the “free-for-all” party scene at Georgetown Preparatory School in the 1980s. The lawsuit alleges that then-HuffPost reporter Ashley Feinberg fabricated details about David Kennedy’s fatal 1984 drug overdose to capitalize on popular interest in the elite, boys-only school that followed Christine Blasey Ford’s allegations of sexual misconduct. HuffPost has since admitted to “mischaracterizing” events surrounding Kennedy’s death. A former classmate of Justice Brett Kavanaugh sued HuffPost for defamation Wednesday, alleging that the liberal news site concocted a false story about their high school’s “party scene” as the Senate reviewed Christine Blasey Ford’s allegations of sexual misconduct. The lawsuit accuses HuffPost and reporter Ashley Feinberg of publishing false information and failing to contact persons she implicated in a crime in a September 2018 article about Georgetown Preparatory School, where Kavanaugh was a student when he allegedly assaulted Ford in the early 1980s. The contested article is an extended interview with an unnamed Georgetown Prep alumnus who described the school’s libertine social life while Kavanaugh was enrolled. The piece identifies the apex of Prep’s alleged debauchery as the 1984 death of David Kennedy, who overdosed on a lethal stimulant-narcotic cocktail at The Brazilian Court Hotel in Palm Beach, Florida. “In HuffPost and Feinberg’s zeal to embellish a salacious article about Justice Kavanaugh’s years at Georgetown Prep and to capitalize upon the controversy surrounding his confirmation hearing and thereby drive traffic to its website, they fabricated the false claim that Douglas Kennedy and Derrick Evans ‘helped score’ the illegal narcotics that killed Douglas’s older brother David in April 1984,” the complaint reads. The plaintiff is Derrick Evans, a teacher and civil rights activist who was a contemporary of Kavanaugh’s at Georgetown Prep. Both Feinberg and HuffPost are named as defendants. Feinberg connected Evans and David’s younger brother, Douglas — both Prep students — to David’s death, claiming the pair procured cocaine for his fatal concoction. Party drugs like cocaine circulated widely, the article said, particularly at “notorious” Prep parties at the Kennedy Hickory Hill estate in nearby McLean, Virginia. “In describing the culture of the school in those days, the former student pointed to the April 1984 overdose of 28-year-old David Kennedy, son of Robert F. Kennedy, who’d injected drugs into his groin, apparently to hide the needle marks. (Cocaine, Demerol, and Mellaril were found in his system,)” Feinberg wrote. “The former student spoke of Kennedy’s death as the end of the school’s free-for-all party scene and the catalyst for changes in Georgetown Prep culture.” “Two Prep students — David’s brother Doug and his friend Derrick Evans — had helped David Kennedy score the coke,” Feinberg added. One day after publication, a Kennedy representative contacted HuffPost and denied Feinberg’s account of David’s death. The representative urged HuffPost to remove the story from their website. That evening, the company appended a correction to the story, saying Evans helped purchase cocaine for David without Douglas’s involvement. The correction cites an affidavit obtained by The New York Times as the basis for the revision. The original story and the correction that followed are “knowingly, recklessly and outrageously false,” Evans’s lawsuit says. The complaint denies that Evans played any role in “scoring” cocaine for Kennedy, and says Feinberg’s initial portrayal of events is “fabricated.” As for the correction, the complaint says the affidavit in question indicates that Evans was merely present when David discussed buying cocaine from two other individuals. A 1984 Times article summarizing that same affidavit reports that Evans cooperated substantially with law enforcement investigating David’s death. Evans’s assistance was a decisive factor in the arrest of two men who sold cocaine to David, according to the Times. As such, Evans says the affidavit does not corroborate the claim made in the correction. Douglas’s attorneys contacted HuffPost one day after the correction appeared, accusing the company of following a “shameful lie with an insincere, incorrect ‘apology’ that placed blame on Mr. Kennedy’s friend [Mr. Evans].” Elsewhere in the lawsuit, Evans alleges that he was not contacted for the story before publication or when the correction was added. “Defendants had no sources to support their outrageously false and defamatory statements about Derrick Evans and Douglas Kennedy,” the lawsuit reads. “Nor did defendants make any effort whatsoever to contact Mr. Evans for comment before accusing him of not only of committing a crime, but of being responsible for the death of David Kennedy.” HuffPost has since substantially edited the story, removing all references to David’s death and expressing regret for mischaracterizing Evans’s involvement. The company has not retracted the story in full or apologized in writing, as Evans requested in a May letter. Evans is seeking unspecified compensatory damages for reputational harm and emotional distress, as well as punitive damages. The case was assigned to Judge Halil S. Ozerden, who President Donald Trump has nominated to the 5th U.S. Circuit Court of Appeals. Neither Feinberg nor HuffPost responded to the Daily Caller News Foundation’s requests for comment. Feinberg has since left HuffPost for Slate. The case is Evans v. Huffington Post.com Inc. in the U.S. District Court for the Southern District of Mississippi. Mitchell - A researcher at the University of Kansas (KU) was indicted today on federal charges of hiding the fact he was working full time for a Chinese university while doing research at KU funded by the U.S. government. Feng “Franklin” Tao, 47, of Lawrence, Kansas, an associate professor at KU’s Center for Environmentally Beneficial Catalysis (CEBC), is charged with one count of wire fraud and three counts of program fraud. He was employed since August 2014 by the CEBC, whose mission is to conduct research on sustainable technology to conserve natural resources and energy. “Tao is alleged to have defrauded the U.S. government by unlawfully receiving federal grant money at the same time that he was employed and paid by a Chinese research university — a fact that he hid from his university and federal agencies,” said Assistant Attorney General Demers for National Security. “Any potential conflicts of commitment by a researcher must be disclosed as required by law and university policies. The Department will continue to pursue any unlawful failure to do so.” The indictment alleges that in May 2018 Tao signed a five-year contract with Fuzhou University in China that designated him as a Changjiang Scholar Distinguished Professor. The contract required him to be a full time employee of the Chinese university. While Tao was under contract with Fuzhou University, he was conducting research at KU that was funded through two U.S. Department of Energy contracts and four National Science Foundation contracts. Kansas Board of Regents’ policy requires staff to file an annual conflict of interest report. In Tao’s reports to KU, he falsely claimed to have no conflicts of interest. The indictment alleges that he fraudulently received more than $37,000 in salary paid for by the Department of Energy and the National Science Foundation. If convicted, he faces up to 20 years in federal prison and a fine up to $250,000 on the wire fraud count, and up to 10 years and a fine up to $250,000 on each of the program fraud counts. The defendant will make his initial appearance Friday, August 23, 2019, in federal court in Kansas City, Kansas. By Jason Hopkins - Data released by the Justice Department reveals that federal arrests of non-citizens has increased exponentially over the past two decades, and account for the majority of all federal arrests. Non-citizens made up 64% of all federal arrests in 2018 despite making up only 7% of the U.S. population, according to Justice Department data released Thursday and reviewed by the Daily Caller News Foundation. Between 1998 and 2018, federal arrests of non-citizens grew by 234%, while federal arrest of U.S. citizens only climbed 10%. While the numbers provide credence to President Donald Trump’s argument that illegal immigration results in increased crime, immigration experts also point out that migrant apprehensions make up a significant portion of current federal arrests. “Experience has taught the immigration agencies and DOJ that this works to reduce recidivism — in other words, when illegal crossers face some more severe consequence than just being sent back home, they don’t keep doing it,” Jessica Vaughan of the Center for Immigration Studies told the Washington Examiner. Trump has made increased immigration enforcement a hallmark goal of his administration. His efforts at beefing up border security and providing additional funding to the Customs and Border Protection have yielded satisfactory results. Federal immigration apprehension climbed more than 50,000 from 2017 to 2018, according to the Justice Department data. While 95% of the increase in federal arrests over the last 20 years were, in fact, due to immigration offenses, other information from the Justice Department indicates that non-citizens do commit crimes in greater proportions than their citizen counterparts. Non-citizens — which only make up 7% of the U.S. population — accounted for 28% of all federal fraud arrests, 25% of all federal property arrests, and 24% of all federal drug arrests. The Justice Department identified the top five crimes non-citizens were most likely be prosecuted for: Illegal re-entry, drugs, fraud, alien smuggling and misuse of visas. “Opponents of immigration enforcement are obsessed with trying to establish that illegal aliens and legal immigrants commit fewer crimes than Americans, and so, as their narrative goes, local law enforcement agencies should not cooperate with ICE and should adopt sanctuary policies,” Vaughan continued in her statement. “This is first of all not true, but is off-point and a dangerous conclusion.” Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
