Napolitano: Trump's Travel Ban Will Be Upheld in 5-4 Supreme Court Vote

Judge Andrew Napolitano predicted Wednesday that he believes President Trump's travel ban will be upheld with a 5 to 4 vote in the Supreme Court.

 

The Trump administration is arguing that the ban is in the best interest of U.S. national security, while critics say the move is discriminatory because it impacts mostly Muslim countries.

 

The justices took the rare step of making an audio recording of Wednesday's proceedings.

 

"I think there are 50 predominantly Muslim countries in the world. Five predominantly Muslim countries are on this list. The population of the predominantly Muslim countries on this list make up about 8 percent of the world's Muslim population," said Justice Samuel Alito in the recording.

I still don't see how an immigration decision by POTUS can be taken to Court; he clearly has power to make such decisions.

Well, according to liberal judges only liberal presidents have the right to do such a thing. No court interfered when Obama created DACA through and EO even though that act is likely unconstitutional. What infuriates me is the R's never challenge DACA in court and now it is entrenched as a "right".

The United States District Court for the Northern District of Texas in Dallas today dismissed the court suit brought by 10 ICE agents against DACA -- the Deferred Action for Childhood Arrivals in which the Administration unilaterally offered a temporary amnesty and work permits to hundreds of thousands of illegal aliens.

The Obama Administration's Department of Homeland Security granted this amnesty despite Congress having repeatedly refused to enact such an amnesty and even voted it down in December 2010. The ICE agents contended that DACA led to their bosses in DHS ordering them to violate what Congress had required them to do through enacted legislation.

The federal court today essentially agreed with the ICE agents.

Activism at its best, he needs to be replaced soon. Thru legislation and the court system is the only way the Regressive agenda gains traction (rams it down the peoples throat), the average normal run of the mill everyday person is against it...

So when R's can't get anything legal done due to Obama's partisan administration that gets a pass, but any hint of that coming from Trump and the world condemns him as an authoritarian?!? The double standard is ... beyond words.

 

Trump should staff positions he wants to fill without waiting for Senate confirmation, and proceed with his agenda.

Let's pray so. We're becoming more and more aware that America has enemies domestically. It is incumbent on a patriotic President to protect us from enemies that are foreign.

Just think as far back as the revolutionary War only so many were involved in the fight against GB and some were in cahoots with the British against other Americans. IIRC they were thinking about deporting all of those who colluded with the Brits but didn't do it, that's a shame...

It is in court precisely because of that reason. The Democrats challenged the ruling, the Administration is arguing it is in their power, therefore it goes to the courts to decide. However, the fact that POTUS does have that power as written in statute is one of the main reasons I believe the SCOTUS will uphold the travel ban.

True. However, now they're not doing much to hide the fact. That's the scary part. 

And what feeds those enemies are those who are openly hostile and hate our President. Their attitude that resorts also to spreading false reports about Trump just adds fuel to the fire of adversity and threat. And they know this, which is why they persist.

We can sell tickets, beer and popcorn, make a fortune off it. But for some reason I don't think it would ever happen, pity that...

 

It's a shame the politicians have to resort to lying and pandering to get elected but that's the way it has to be I suppose for them to acquire the power they crave. This should be a big tipoff to the average voter that the people wanting their vote doesn't have their best interests in mind, maybe one day it will sink in to a larger percentage of them...

.This shouldn't be surprising. Our FF's knew government is evil, but a necessary evil. By definition, that means anyone is evil once elected. And any election will necessarily be a choice of the lesser of two evils.

 

FAR better than any other sort of government! And much of the world recognized this pretty quickly.

Supreme Court upholds Trump travel ban on some Muslim-majority nations

The Supreme Court on Tuesday upheld President Trump’s controversial travel ban affecting several mostly Muslim countries, offering a limited endorsement of the president’s executive authority.

The ruling was 5-4 upholding the selective travel restrictions, which critics have dubbed a “Muslim ban” but the administration argued was needed for security reasons.

At issue was whether the third and latest version of the administration's policies affecting visitors from five majority Muslim nations – known as travel ban 3.0 -- discriminates on the basis of nationality and religion, in the government's issuance of immigrant visas.

Chief Justice John Roberts wrote that the order was “squarely within the scope of Presidential authority” under federal law.
